1.About these terms
These Terms & Conditions apply to every shipment and service provided by Salihiya Star Express ("we", "us", "the Company"), of Powerline Tower, near Maria Stop, First Avenue, Eastleigh, Nairobi, Kenya. "You" or "the Customer" means the person or business sending, receiving or paying for the goods.
By requesting a quote, handing over goods, or paying for a shipment, you agree to these terms. If anything here conflicts with a written agreement signed by both of us, the signed agreement applies.
2.Our services
We arrange air freight, sea freight, road transport, consolidation, customs clearance support and collection or delivery of goods to Kenya from our listed routes. We may use airlines, shipping lines, transporters, warehouses and clearing agents to carry out the service; their own conditions of carriage may also apply to your goods.
3.Your responsibilities
You must:
- Describe your goods truthfully and declare their real value, quantity and weight.
- Make sure the goods are legal to export and import, and are not prohibited.
- Pack goods properly for the journey and mark every carton with your shipping mark (name and phone).
- Provide documents we ask for, such as your ID, KRA PIN, supplier invoice, packing list and any permits.
- Pay all charges, duties and taxes when due.
You are responsible for any fines, penalties, extra costs or damage caused by wrong information, poor packing, or prohibited or restricted goods.
4.Prohibited and restricted goods
We do not carry goods that are illegal or banned by Kenyan law, airlines or shipping lines. See our Prohibited & Restricted Items list. We may open and inspect any package, refuse to ship it, or hand it over to the authorities. Goods seized by customs or other authorities are not refunded, and you remain liable for related charges.
5.Quotes, rates and estimates
- Prices from our Shipping Calculator and website are estimates only.
- Final charges are based on the actual weight and size of your goods, measured at our warehouse. Air freight is charged on the higher of actual weight or volume weight (L × W × H cm ÷ 6000). Sea freight is charged per cubic metre (CBM) or by weight, whichever is higher.
- A written quote is valid for 7 days unless it says otherwise.
- Rates may change because of fuel costs, carrier charges, exchange rates or government levies. We will tell you before shipping if your price changes.
- Unless stated, prices exclude customs duties and taxes, insurance, storage and local delivery.
6.Payment
Freight charges and any duties or taxes must be paid in full before goods are released, unless we agree otherwise in writing. Payments in Kenya Shillings are converted at the exchange rate we apply on the day of payment. Ask us for accepted payment methods; always get a receipt.
7.Customs duties and taxes
Goods imported into Kenya may attract import duty, VAT, the Import Declaration Fee, the Railway Development Levy, excise duty and other charges set by the Kenya Revenue Authority (KRA). These are your responsibility. We help with clearance, but the amounts are decided by KRA and other authorities, not by us. See our Import Guide.
8.Transit times and delays
Departure dates and transit times on our Departure Schedule and quotes are estimates, not guarantees. We are not responsible for delays caused by airlines, shipping lines, customs inspections, missing documents, weather, port congestion, strikes, public holidays or other events outside our control.
9.Tracking and communication
Tracking updates on our website and messages by WhatsApp, SMS or email are provided for information. We try to keep them accurate and up to date, but the status shown may not reflect every movement of your goods in real time.
10.Collection, delivery and storage
- We will notify you when your goods are ready. Collect them from our Eastleigh office with your ID and tracking number or receipt.
- Someone collecting for you must bring your written authorisation and their own ID.
- Goods may be stored free for 7 days after we notify you. After that, storage charges may apply.
- Goods not collected within 90 days of notification, after reasonable attempts to contact you, may be sold or disposed of as allowed by law, to recover charges owed.
11.Checking your goods
Please check the number of cartons and their condition before leaving our office or signing for delivery. Visible damage or missing cartons must be noted at collection. Hidden damage must be reported to us in writing within 3 days of collection.
12.Liability and claims
- We take reasonable care of your goods. Unless you buy cargo insurance through us, our liability for loss or damage is limited to the freight charges you paid for the affected goods.
- We are not liable for loss or damage caused by poor packing, the nature of the goods (for example fragile, perishable or liquid goods), wrong or incomplete information, customs or government action, or events outside our control.
- We are not liable for indirect losses such as loss of profit, business or market.
- Claims must be made in writing within 14 days of collection or of the date the goods should have arrived, with your receipt, photos and proof of value.
We strongly recommend insuring valuable goods. Ask us about cargo insurance before shipping.
13.Right to hold goods
We may hold your goods until all charges owed to us for those or earlier shipments are paid in full.
14.Cancellations and refunds
You may cancel before your goods are shipped. Costs already incurred (such as collection, warehouse handling or booking fees) will be charged. Once goods have departed, freight charges are not refundable.
15.Privacy
We collect your name, phone number, email and shipment details when you request a quote, contact us or ship with us. We use them only to provide our services, keep you updated about your shipment and meet legal requirements such as customs clearance. We share them only with carriers, agents and authorities involved in your shipment, and never sell them.
We handle personal data in line with Kenya's Data Protection Act, 2019. You can ask to see, correct or delete your information by contacting us.
16.Changes, governing law and disputes
We may update these terms from time to time; the version on this page applies to new shipments. These terms are governed by the laws of Kenya. We will try to settle any dispute through discussion first; if that fails, the courts of Kenya will have jurisdiction.
